How odd that Americans, and not just their presidents, have come to think of their Constitution as something separable from the government it's supposed to constitute. In theory, it should be as binding on rulers as the laws of physics are on engineers who design bridges; in practice, its axioms have become mere options. Of course engineers don't have to take oaths to respect the law of gravity; reality gives them no choice. Politics, as we see, makes all human laws optional for politicians.Joseph Sobran Practice Of Law Sayings By Joseph Sobran: How odd that Americans, and not just their presidents, have come to think of their

Religious freedom doesn't include the freedom to disregard the law and restrict another's freedom to believe and act differently. No one's forcing Catholic nuns to practice birth control, or priests to wear condoms (good idea tho). If you really feel your religious beliefs conflict with the mandates of running a business, the solution is simple: Get your ass out of the boardroom and back to the pulpit (where it belongs).Quentin R. I think it perfectly just, that he who, from the love of experiment, quits an approved for an uncertain practice, should suffer the full penalty of Egyptian law against medical innovation; as I would consign to the pillory, the wretch, who out of regard to his character, that is, to his fees, should follow the routine, when, from constant experience he is sure that his patient will die under it, provided any, not inhuman, deviation would give his patient a chance.Thomas Beddoes Practice Of Law Sayings By Thomas Beddoes: I think it perfectly just, that he who, from the love of experiment, quits an
By nature's law, every man has a right to seize and retake by force his own property taken from him by another, by force of fraud. A certain kind of methodologically-minded philosopher of science is quick to read off metaphysical conclusions from features of scientific practice. Chemists don't derive their laws from fundamental physics, so reductive physicalism must be false. Biologists refer to natural numbers in some of their explanations, so numbers must exist. I think that this kind of thing makes for bad philosophy.David Papineau Practice Of Law Sayings By David Papineau: A certain kind of methodologically-minded philosopher of science is quick to read off metaphysical conclusions

Democracy demands that the religiously motivated translate their concerns in to universal, rather than religion-specific, values ... it requires that their proposals be subject to argument and amenable to reason.
Now I may be opposed to abortion for religious reasons, to take one example, but if I seek to pass a law banning the practice, I cannot simply point to the teachings of my church or evoke God's will. I have to explain why abortion violates some principle that is accessible to people of all faiths, including those with no faith at all.

The lamb was to be eaten with bitter herbs, as pointing back to the bitterness of the bondage in Egypt. So when we feed upon Christ, it should be with contrition of heart, because of our sins. The use of unleavened bread also was significant. It was expressly enjoined in the law of the Passover, and as strictly observed by the Jews in their practice, that no leaven should be found in their houses during the feast. In like manner the leaven of sin must be put away from all who would receive life and nourishment from Christ. So Paul writes to the Corinthian church, "Purge out therefore the old leaven, that ye may be a new lump ... For even Christ our Passover is sacrificed for us: therefore let us keep the feast, not with old leaven, neither with the leaven of malice and wickedness; but with the unleavened bread of sincerity and truth." 1 Corinthians 5:7, 8.Ellen G. White Practice Of Law Sayings By Ellen G. White: The lamb was to be eaten with bitter herbs, as pointing back to the bitterness
In Confucian thought, individuals practice moral virtue both by restraining themselves and pursuing their own interests. This is a dual push-and-pull process. In today's China, the latter is taken care of by capitalism and commerce. The former, however, needs to be taken care of by the rule of law. Otherwise, the system of governance is corrupted by unrestrained individual desires and selective enforcement of 'virtue' or law.Patrick Mendis Practice Of Law Sayings By Patrick Mendis: In Confucian thought, individuals practice moral virtue both by restraining themselves and pursuing their own
The state which is regarded as the instrument for universalizing a certain religion must perforce be an ever expanding state. Yet if the Howard years changed little in the law, they had a huge effect on the culture. Most Australians certainly became wealthier, but in the process they became more materialistic and self-centred. Howard constantly held up the ideal of mateship, but in practice he was much more concerned with individuals taking responsibility for themselves than in fostering genuine co-operation within communities, let alone in a wider international context. Indeed, much of his political success derived from setting groups against each other, from bolstering fear and loathing.Mungo MacCallum Practice Of Law Sayings By Mungo MacCallum: Yet if the Howard years changed little in the law, they had a huge effect

America's Christian conservative movement is confronted with this divide: small-government advocates who want to practice their faith independent of heavy-handed government versus big-government sympathizers who want to impose their version of 'righteousness' on others through the hammer of law ... The nation as such is not a large subject that has needs, that works, practices economy, and consumes ... Thus the phenomena of "national economy" ... are, rather, the results of all the innumerable individual economic efforts in the nation and ... must also be theoretically interpreted in this light ... Whoever wants to understand theoretically the phenomena of "national economy" ... must for this reason attempt to go back to their true elements, to the singular economies in the nation, and to investigate the laws by which the former are built up from the latter.Ralph Raico Practice Of Law Sayings By Ralph Raico: The nation as such is not a large subject that has needs, that works, practices
Seek ye first the kingdom of God, and his righteousness; and all these things shall be added unto you (Matthew 6:33). The principle that Jesus expressed in these words is the basic law that underlies all answer to prayer. Many people know this in theory but are confused about putting it into practice. They think, "I will ignore this problem and think about God instead." Here there is a subtle mistake; because they are really thinking of their problem as existing in one place, of God as existing in another, and of themselves as going in thought from the first place to the second place. This, of course, is by implication to reaffirm the existence of the problem in its own place, and such a belief will not heal. What we have to do is to seek the Kingdom in the very place where the trouble seems to be. We have to know that in Truth and reality it is not there, because God is there. When we succeed in doing this, the difficulty disappears.Emmet Fox Practice Of Law Sayings By Emmet Fox: Seek ye first the kingdom of God, and his righteousness; and all these things shall
For neo-conservatism is a quintessentially Jewish project: a re-sanctification in everyday life of the core values of western civilisation, and the achievement of human potential through virtuous practice. The neo-cons' crucial insight is that public signals through law, custom and tradition are the key to getting people to behave well. And that is a Jewish insight.Melanie Phillips Practice Of Law Sayings By Melanie Phillips: For neo-conservatism is a quintessentially Jewish project: a re-sanctification in everyday life of the core

the creative power of the judicial system in shaping the law cannot be overlooked entirely. This factor needs to be consciously accepted as one of the elements in shaping the legal system and the laws, however, without least opposing the Supremacy of the Sovereign statutes promulgated in the land. The chasm in the contemporaneous legal scheme and the legislation in Oman harbingers for such a practice to secure the ends of justice, probability of decisions to be given primacy rather than approximation to a model format.Henrietta Newton Martin Practice Of Law Sayings By Henrietta Newton Martin: the creative power of the judicial system in shaping the law cannot be overlooked entirely.
It takes about ten years to make a mature dancer. The training is twofold. There is the study and practice of the craft in order to strengthen the muscular structure of the body. The body is shaped, disciplined, honored, and in time, trusted. The movement become clean, precise, eloquent, truthful. Movement never lies. It is a barometer telling the state of the soul's weather to all who can read it. This might be called the law of the dancer's life, the law which governs its outer aspectsMartha Graham Practice Of Law Sayings By Martha Graham: It takes about ten years to make a mature dancer. The vague yet menacing government agency would like to remind you that UFOs are totally not a thing. They remind you that UFOs are merely weather balloons, and further, that weather balloons are merely misplaced clouds, that clouds are merely dreams that have escaped our sleep, that sleep is merely a practice for death, that death is merely another facet of our world, no different from, say, sand or bicycles, and that the great glowing earth is merely the last thoughts of a dying man, laughing and shaking his head weakly at the improbability of it all. Remember, it's not just the law. It's anJoseph Fink Practice Of Law Sayings By Joseph Fink: The vague yet menacing government agency would like to remind you that UFOs are totally

As for the liberty of the press, like every other privilege, it must be restrained within certain bounds; for if it is carried to a breach of law, religion, and charity, it becomes one of the greatest evils that ever annoyed the community. If the lowest ruffian may stab your good-name with impunity in England, will you be so uncandid as to exclaim against Italy for the practice of common assassination? To what purpose is our property secured, if our moral character is left defenceless? PeopleTobias Smollett Practice Of Law Sayings By Tobias Smollett: As for the liberty of the press, like every other privilege, it must be restrained
The truth, however, is that most Muslims appear to be "fundamental-
ist" in the Western sense of the word - in that even "moderate"
approaches to Islam generally consider the Koran to be the literal and
inerrant word of the one true God. The difference between funda-
mentalists and moderates - and certainly the difference between all
"extremists" and moderates - is the degree to which they see political
and military action to be intrinsic to the practice of their faith. In any
case, people who believe that Islam must inform every dimension of
human existence, including politics and law, are now generally called
not "fundamentalists" or "extremists" but, rather, "Islamists.
Sam Harris Practice Of Law Sayings By Sam Harris: The truth, however, is that most Muslims appear to be "fundamental-ist" in the Western sense
We are His children in Very deed, having been born of Him in the spirit, and we have inherited the very attributes which he possesses. Richards Practice Of Law Sayings By George F. Richards: We are His children in Very deed, having been born of Him in the spirit,
In the late 1860s, Myra Bradwell petitioned for a law license and argued that the 14th Amendment protected her right to practice. The Illinois Supreme Court rejected her petition, ruling that because she was married she had no legal right to operate on her own. When she challenged the ruling, Justice Joseph Bradley wrote in his decision, "It certainly cannot be affirmed, as a historical fact, that [the right to choose one's profession] has ever been established as one of the fundamental privileges and immunities of the sex." Rather, Bradley argued, "The paramount destiny and mission of women are to fulfill the noble and benign offices of wife and mother."40 Meanwhile,Rebecca Traister Practice Of Law Sayings By Rebecca Traister: In the late 1860s, Myra Bradwell petitioned for a law license and argued that the
All violation of established practice implies in its own nature a rejection of the common opinion, a defiance of common censure, and an appeal from general laws to private judgment: he, therefore, who differs form others without apparent advantage, ought not to be angry if his arrogance is punished with ridicule; if those whose example he superciliously overlooks, point him out to derision, and hoot him back again into the common road.Samuel Johnson Practice Of Law Sayings By Samuel Johnson: All violation of established practice implies in its own nature a rejection of the common
The words 'theory' and 'practice' are of Greek origin; they carry our thoughts back to the ancient philosophers by whom they were contrived, and by whom they were also contrasted and placed in opposition, as denoting two mutually conflicting and mutually inconsistent ideas ... [this fallacy] based on a double system of natural laws retarded for centuries the development of physical science, notably mechanics.William John Macquorn Rankine Practice Of Law Sayings By William John Macquorn Rankine: The words 'theory' and 'practice' are of Greek origin; they carry our thoughts back to

It is easier to allow a few women to occupy positions of authority and dominance than to question whether social life should be organized around principles of hierarchy, control, and dominance at all, to allow a few women to reach the heights of the corporate hierarchy rather than question whether people's needs should depend on an economic system based on dominance, control, and competition. It is easier to allow women to practice law than to question adversarial conflict as a model for resolving disputes and achieving justice. It has even been easier to admit women to military combat roles than to question the acceptability of warfare and its attendant images of patriarchal masculine power and heroism as instruments of national policy. And it has been easier to elevate and applaud a few women than to confront the cultural misogyny that is never far off, waiting in the wings and available for anyone who wants to use it to bring women down and put them in their place.Allan G. Johnson Practice Of Law Sayings By Allan G. Johnson: It is easier to allow a few women to occupy positions of authority and dominance

As a means of subsidizing lawyers the present nuclear regulation system is well designed - but is there not perhaps a cheaper way of rewarding legal diligence? With reason, then, the common opinion of mankind, little affected by the few dissentients who have contended for the opposite view, has found in the careful study of nature, and in the laws of nature, the foundations of the division of property, and the practice of all ages has consecrated the principle of private ownership, as being pre-eminently in conformity with human nature, and as conducing in the most unmistakable manner to the peace and tranquility of human existence.Pope Leo XIII Practice Of Law Sayings By Pope Leo XIII: With reason, then, the common opinion of mankind, little affected by the few dissentients who

F. Franklin the Fourth has a job with a firm rich in heritage, money and pretentiousness, a firm vastly superior to Brodnax and Speer. His sidekicks at the moment are W. Harper Whittenson, an arrogant little snot who will, thankfully, leave Memphis and practice with a mega-firm in Dallas; J. Townsend Gross, who has accepted a position with another huge firm; and James Straybeck, a sometimes friendly sort who's suffered three years of law school without an initial to place before his name or numerals to stick after it. With such a short name, his future as a big-firm lawyer is in jeopardy. I doubt if he'll make it.John Grisham Practice Of Law Sayings By John Grisham: F. The two areas growing fastest - IP litigation and labor & employment - together make up only 13% of law firm revenue, while the six shrinking segments account for 32% of revenue (note that the practice areas displayed account only for about 75% of total revenue, presumably because displaying them all would require more detail than would be useful).Bruce Macewen Practice Of Law Sayings By Bruce Macewen: The two areas growing fastest - IP litigation and labor & employment - together make

Though this motion for a new trial is an application to the discretion of the Court, it must be remembered that the discretion to be exercised on such an occasion is not a wild but a sound discretion, and to be confined within those limits within which an honest man, competent to discharge the duties of his office, ought to confine himself. And that discretion will be best exercised by not deviating from the rules laid down by our predecessors; for the practice of the Court forms the law of the Court.Sherrilyn Kenyon Practice Of Law Sayings By Sherrilyn Kenyon: Though this motion for a new trial is an application to the discretion of the
Slavery was, in a very real sense, the first
international human rights issue to come to the fore. It led to the
adoption of the first human rights laws and to the creation of the
first human rights non-governmenta l organization. And yet despite
the efforts of the international community to combat this abhorrent
practice, it is still widely prevalent in all
its insidious forms, old and new.

Law and order is a social service. Crime and the fear which the threat of crime induces can paralyse whole communities, keep lonely and vulnerable elderly people shut up in their homes, scar young lives and raise to cult status the swaggering violent bully who achieves predatory control over the streets. I suspect that there would be more support and less criticism than today's political leaders imagine for a large shift of resources from Social Security benefits to law and order - as long as rhetoric about getting tough on crime was matched by practice.Margaret Thatcher Practice Of Law Sayings By Margaret Thatcher: Law and order is a social service. If we are going to create a financial system that works for all Americans, we have got to stop financial institutions from ripping off the American people by charging sky-high interest rates and outrageous fees.
In my view, it is unacceptable that Americans are paying a $4 or $5 fee each time they go to the ATM.
It is unacceptable that millions of Americans are paying credit card interest rates of 20 or 30 percent.
The Bible has a term for this practice. It's called usury. And in The Divine Comedy, Dante reserved a special place in the Seventh Circle of Hell for those who charged people usurious interest rates.
Today, we don't need the hellfire and the pitch forks, we don't need the rivers of boiling blood, but we do need a national usury law.

A recent book by University of Chicago professor of philosophy and law Brian Leiter outlines what I believe will become the theoretical consensus that does away with religious liberty in spirit if not in letter. "There is no principled reason," he writes, "for legal or constitutional regimes to single out religion for protection." . . . Evoking the principle of fairness, Leiter argues that everybody's conscience should be accorded the same legal protections. Thus he proposes to replace religious liberty with a plenary "liberty of conscience."

Leiter's argument is libertarian. He wants to get the government out of the business of deciding whose conscience is worth protecting. This mentality seems to expand freedom, but that's an illusion. In practice it will lead to diminished freedom, as is always the case with any thoroughgoing libertarianism.

Next to the ministry I know of no more noble profession than the law. crop. Gains from trade likewise accrue to those with the power to exclude. Conflict over those powers also takes legal form. When the legal entitlements people assert are confirmed in practice, the powers and vulnerabilities of people in struggle are defined. As conflict continues, law consolidates gains and losses, solidifying relations between winners and losers. Over time, patterns emerge and inequalities can be reproduced or deepened. I illuminate that process borrowing Gunnar Myrdal's analytic framework for understanding dualist dynamics between centers and peripheries.David Kennedy Kennedy Practice Of Law Sayings By David Kennedy Kennedy: crop. Here monogamy, there hetaerism and its most extreme form, prostitution. Hetaerism is as much a social institution as all others. It continues the old sexual freedom - for the benefit of the men. In reality not only permitted, but also assiduously practised by the ruling class, it is denounced only nominally. Still in practice this denunciation strikes by no means the men who indulge in it, but only the women. These are ostracised and cast out by society, in order to proclaim once more the fundamental law of unconditional male supremacy over the female sex. However,Friedrich Engels Practice Of Law Sayings By Friedrich Engels: Here monogamy, there hetaerism and its most extreme form, prostitution. Hetaerism is as much a

We can bring brilliant flowers of victory to bloom in our lives when we weather the hardships of winter and emerge triumphant based on our practice of the Mystic Law.
